Advocacy - Fraud and AbuseFraud and Abuse
The federal government has developed a series of laws to help prevent and prosecute fraud and abuse in the Medicare and Medicaid systems. The Stark II law (aka the physician self-referral law) and the federal anti-kickback law effect almost every relationship a physician has with other healthcare entities, including hospitals, pharmaceutical companies, group practices, ancillary providers and other physicians. In essence, anytime a physician receives something of value, including money, from a healthcare entity, the fraud and abuse laws must be complied with. The materials in this area are provided as an overview of the topic and a summary of the Washington Committee’s activities and are in no way a substitute for professional legal advice.
